Introductory provisions<\/strong><\/p>\n<p>1.1 These Terms and Conditions (hereinafter referred to as \"<strong>Terms and Conditions<\/strong>\") is published by Um\u011bn\u00ed cestovat s.r.o., ID: 23200936, VAT: CZ23200936, with registered office at Uralsk\u00e1 689\/7, Prague 6, 160 00, Czech Republic, e-mail: info@artoftravel.shop, tel: +420 910 121 186 (hereinafter referred to as \"<strong>Seller<\/strong>\"), within the meaning of Section 1751(1) of Act No. 89\/2012 Coll., the Civil Code, as amended (hereinafter referred to as \"<strong>OZ<\/strong>\").<br>1.2 The Terms and Conditions govern the mutual rights and obligations of the Seller and the natural or legal person who concludes a distance purchase contract through the online store located at <a>https:\/\/artoftravel.shop<\/a> (hereinafter referred to as \"<strong>Buyer<\/strong>\").<br>1.3 Deviating provisions from the Terms may only be agreed in writing; deviating provisions shall prevail over the Terms.<br>1.4 The rights and obligations not covered by the Terms and Conditions are governed by the CC, Act No. 634\/1992 Coll., on Consumer Protection, and the relevant European Union legislation, in particular Directive 2011\/83\/EU.<\/p>\n<p><strong>2. Definition of terms<\/strong><\/p>\n<ul data-spread=\"false\">\n<li><strong>E-shop<\/strong>&nbsp;- internet shop operated by the Seller on the domain artoftravel.shop.<\/li>\n<li><strong>Consumer<\/strong>&nbsp;- A buyer who, outside the scope of his business activity, concludes a contract with the Seller (\u00a7 419 CC).<\/li>\n<li><strong>Entrepreneur<\/strong>&nbsp;- Buyer acting in the course of his business (\u00a7 420 CC).<\/li>\n<li><strong>Pre-sale<\/strong>&nbsp;- sale of products that are not yet in stock and whose production and dispatch are provided by a third party.<\/li>\n<li><strong>Distance contract<\/strong> - a purchase contract concluded by means of distance communication.\n<\/li>\n<\/ul>\n<p><strong>3. Order and conclusion of the purchase contract<\/strong><\/p>\n<p>3.1 All presentation of goods on the website is informative; the Seller is not obliged to conclude a contract regarding such goods (\u00a7 1732 CC).<br>3.2 The Purchase Contract shall be formed at the moment of receipt of acceptance of the order (acceptance) by the Seller to the Buyer's e-mail.<br>3.3 The Buyer agrees to the use of remote means of communication. Costs incurred by the Buyer in connection with the use of such means shall be borne by the Buyer.<\/p>\n<p><strong>4. Price of goods and payment terms<\/strong><\/p>\n<p>4.1 Prices are quoted in Czech crowns (CZK) and euros (EUR) including the applicable VAT rate.<br>4.2 The buyer may pay the price:<\/p>\n<ul data-spread=\"false\">\n<li>cashless payment by credit card online,<\/li>\n<li>by bank transfer,<\/li>\n<li>cash on delivery (selected countries only).<\/li>\n<\/ul>\n<p>4.3 In the case of non-cash payment, the purchase price is payable within 5 days of the conclusion of the contract.<\/p>\n<p><strong>5. The Buyer is obliged to inspect the goods upon receipt and immediately notify the carrier and the Seller of any defects.<\/p>\n<p><strong>6. Rights from defective performance (claims)<\/strong><\/p>\n<p>7.1 The rights and obligations of the contracting parties regarding defects are governed by the provisions of Sections 2099 - 2117 CC and the Consumer Protection Act.<br>7.2 The warranty period is 24 months, unless otherwise stated on the goods.<br>7.3 Complaint Procedure:<\/p>\n<ol start=\"1\" data-spread=\"false\">\n<li>The buyer fills in the complaint form and gives a description of the defect.<\/li>\n<li>Seller will send a return label (except IE, LU, DK, FI, SE).<\/li>\n<li>Upon delivery of the goods, the Seller will settle the claim within&nbsp;<strong>30 days<\/strong> (\u00a7 19 of the Consumer Protection Act).<\/li>\n<\/ol>\n<p>7.4 Complaints do not apply to goods damaged by improper use (e.g. use of other textile fixtures than recommended).<\/p>\n<p><strong>8. Exchange of goods<\/strong><\/p>\n<p>8.1 Exchanges can be made within 14 days of receipt of the goods.<br>8.2 The exchange procedure is identical to the withdrawal procedure, except that the Buyer places a new order for the requested goods in the E-shop at the same time.<br>8.3 The cost of return and reshipment shall be as per the table in Article 6.3.<\/p>\n<p><strong>9. Privacy Policy<\/strong><\/p>\n<p>9.1 The Seller processes personal data in accordance with Regulation (EU) 2016\/679 (GDPR). Details are set out in a separate <strong>Privacy Statement<\/strong>.<\/p>\n<p><strong>10. Out-of-court dispute resolution<\/strong><\/p>\n<p>10.1 The consumer has the right to contact the Czech Trade Inspection Authority (<a>www.coi.cz<\/a>) or use the platform <strong>ODR<\/strong> European Commission (<a>https:\/\/ec.europa.eu\/consumers\/odr<\/a>).<\/p>\n<p><strong>11. Governing law and jurisdiction<\/strong><\/p>\n<p>11.1 The Purchase Agreement is governed by the law of the Czech Republic.<br>11.2 The court of the Czech Republic with jurisdiction over disputes is competent in terms of subject matter and place of jurisdiction according to the Seller's registered office, unless otherwise provided by mandatory consumer protection legislation.<\/p>\n<p><strong>12. Final provisions<\/strong><\/p>\n<p>12.1 The Seller may unilaterally change the Terms and Conditions; the version effective on the date of conclusion of the Purchase Agreement is binding for the Buyer.<br>12.2 If any provision of the Terms is invalid or ineffective, the provision closest in meaning shall apply. INTRODUCTORY PROVISIONS<\/strong><\/p><p data-start=\"313\" data-end=\"623\">1.1 The controller of personal data within the meaning of Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (General Data Protection Regulation) (hereinafter referred to as \"GDPR\") is:<\/p><p data-start=\"625\" data-end=\"905\">Company \/ name: Um\u011bn\u00ed cestovat s.r.o.<br data-start=\"665\" data-end=\"668\" \/>Headquarters \/ address: 689\/7 Uralsk\u00e1 Street, 160 00 Prague 6 - Bubene\u010d, Czech Republic<br data-start=\"744\" data-end=\"747\" \/>ICKO: 232 00 936<br \/>DIC: CZ23200936<br \/>Contact: e-mail: <a class=\"decorated-link cursor-pointer\" rel=\"noopener\" data-start=\"828\" data-end=\"849\">info@artoftravel.shop<\/a><br data-start=\"879\" data-end=\"882\" \/>(hereinafter referred to as the \"Administrator\").<\/p><p data-start=\"907\" data-end=\"1334\">1.2 When processing personal data, the Administrator shall comply with the GDPR, Act No. 101\/2000 Coll., on the protection of personal data, Act No. 89\/2012 Coll., the Civil Code, and other related legislation.<br data-start=\"1099\" data-end=\"1102\" \/>1.3 Below is a list of personal data, the manner in which they are processed, the period for which your personal data are processed, the purpose of the processing, as well as the information provided to you as data subjects by the controller.<\/p><p data-start=\"907\" data-end=\"1334\"><strong data-start=\"1277\" data-end=\"1308\">2. CATEGORIES OF PERSONAL DATA<\/strong><\/p><p data-start=\"1311\" data-end=\"1378\">2.1 The controller processes only the strictly necessary basic data, namely:<\/p><ul data-start=\"1379\" data-end=\"1751\"><li data-start=\"1379\" data-end=\"1539\"><p data-start=\"1381\" data-end=\"1539\">Identification data (your name and surname, business name, residential or registered office address, if applicable also your delivery address, VAT number, tax identification number, your date of birth),<\/p><\/li><li data-start=\"1540\" data-end=\"1751\"><p data-start=\"1542\" data-end=\"1751\">contact details (your email and phone number, or IP address).<\/p><\/li><\/ul><p data-start=\"1542\" data-end=\"1751\">2.2 The controller processes personal data that you have provided to the controller or personal data that the controller has obtained as a result of the fulfilment of your order.<\/p><p data-start=\"1758\" data-end=\"1808\"><strong data-start=\"1761\" data-end=\"1806\">3. REASON AND PURPOSE FOR PROCESSING PERSONAL DATA<\/strong><\/p><p data-start=\"1809\" data-end=\"1862\">3.1 The lawful reason for processing personal data is:<\/p><ul data-start=\"1863\" data-end=\"2475\"><li data-start=\"1863\" data-end=\"1932\"><p data-start=\"1865\" data-end=\"1932\">the performance of a contract to which you as the data subject are a party,<\/p><\/li><li data-start=\"1933\" data-end=\"1971\"><p data-start=\"1935\" data-end=\"1971\">the fulfilment of the legal obligation of the administrator,<\/p><\/li><li data-start=\"1972\" data-end=\"2034\"><p data-start=\"1974\" data-end=\"2034\">the legitimate interest of the controller in providing direct marketing,<\/p><\/li><li data-start=\"2035\" data-end=\"2475\"><p data-start=\"2037\" data-end=\"2475\">your consent to the processing of personal data for the purpose of direct marketing (sending commercial communications and newsletters).<\/p><\/li><\/ul><p data-start=\"2037\" data-end=\"2475\">3.2 The controller processes personal data for the purpose of processing your order, for the purpose of fulfilling its own legal obligations towards the state (e.g. tax) and for marketing activities.<br \/>3.3 You may withdraw your consent to the sending of commercial communications to the controller at any time (see paragraph 7.6 of the Policy).<\/p><p data-start=\"2482\" data-end=\"2524\"><strong data-start=\"2485\" data-end=\"2522\">4. RETENTION PERIOD OF PERSONAL DATA<\/strong><\/p><p data-start=\"2525\" data-end=\"3068\">4.1 The controller shall retain your personal data for the period necessary to exercise the rights and obligations arising from the contractual relationship or for the period necessary to fulfil archiving obligations under other legislation (Accounting Act, Archives and Records Act, VAT Act), but no longer than 10 years after the termination of the contractual relationship. Unless you withdraw your consent to the processing of personal data for direct marketing purposes, the data is processed for a maximum of 3 years.<br data-start=\"2988\" data-end=\"2991\" \/>4.2 We will delete your personal data after the retention period has expired.<\/p><p data-start=\"3075\" data-end=\"3113\"><strong data-start=\"3078\" data-end=\"3111\">5. SECURITY OF PERSONAL DATA<\/strong><\/p><p data-start=\"3114\" data-end=\"3453\">5.1 Taking into account the state of the art, the cost of implementation, the nature, scope, context and purposes of the processing, as well as the different likely and different risks to the rights and freedoms of natural persons entailed by the processing, the controller has put in place appropriate technical and organisational measures to comply with the GDPR and to protect the rights of data subjects.<\/p><p data-start=\"3460\" data-end=\"3495\"><strong data-start=\"3463\" data-end=\"3493\">6. RECIPIENTS OF PERSONAL DATA<\/strong><\/p><p data-start=\"3496\" data-end=\"3548\">6.1 The controller transfers personal data to the following recipients:<\/p><ul data-start=\"3549\" data-end=\"3807\"><li data-start=\"3549\" data-end=\"3570\"><p data-start=\"3551\" data-end=\"3570\">external accountants,<\/p><\/li><li data-start=\"3571\" data-end=\"3807\"><p data-start=\"3573\" data-end=\"3807\">payment service providers and payment processors to secure the transfer of funds.<\/p><\/li><\/ul><p data-start=\"3573\" data-end=\"3807\">6.2 We do not transfer your personal data to a country outside the European Union.
